These Terms of Use ("Terms of Use " or “Terms”) are a legal contract between you (“You/Your”) and Yeti My Friend Inc. (“Us” or “We” or “Our” or “Yeti My Friend”). Yeti My Friend is the creator of a mobile application designed to teach critical thinking and character-building skills to elementary school children (each, a “Learner”) through interactive storytelling (the “App”). Yeti My Friend also provides access to our website (the “Site”). The App, Site, and all relevant content and functionality associated with the App and Site are collectively known as the “Services.” These Terms govern Your use of the Services and the use of the Services by Learner(s) You authorize to download the App and/or use the Services. These Terms apply to all users (“Users”) who access and use the Services through a user account (“User Account”). If You are a parent or guardian of a Learner, these Terms refer to You as a “Guardian.”

These terms refer to teachers, school administrators, and other school personnel who use the Services as part of their educational program or materials offered through a school, school district, or other similar educational institution (“School”) as “Educators.” The use of the Services by Educators is governed by Our contracts with the School. In the event of a conflict between these Terms and Our contract with the School, the contract with the School will govern.

EXCEPT WITH RESPECT TO USER ACCOUNTS CREATED BY EDUCATORS AS DESCRIBED ABOVE, BY CREATING A USER ACCOUNT AND/OR USING OR PERMITTING A LEARNER TO USE THE SERVICES, YOU ARE ACKNOWLEDGING AND AGREEING TO THESE ON BEHALF OF THE LEARNER(S) YOU AUTHORIZE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD THE APP OR PERMIT A LEARNER TO DOWNLOAD THE APP OR LOG IN TO OR USE THE SERVICES OR PERMIT A LEARNER TO LOG IN OR USE THE SERVICES.

IF YOU ARE UNDER THE AGE OF 13, YOU PARENT OR GUARDIAN MUST SET UP A USER ACCOUNT FOR YOU. IF YOU ARE UNDER THE AGE OF 18, YOUR PARENT OR GUARDIAN MUST READ AND AGREE TO THESE TERMS FOR YOU.

User Account

You must create a User Account to enable a Learner to access and use the Services. The registration process begins when You enter Your email address and a password on the App. Once You have entered Your email address and a password, We will send You an email to verify Your email address. After verifying Your email address, You will enter Your Learner’s first name and grade on the App (Your “Registration, Contact, and Account Information”). From there, You will receive an email invitation to create a password to enable Your Learner(s) to access and use the Services.

If You are an Educator, You may enter certain Registration, Contact, and Account Information on the App which may include, but is not limited to, Your name, Your email address, and the grade that You teach. Once You have entered Your Registration, Contact, and Account Information, We will contact You to initiate the Learner onboarding process.

You agree not to register for a User Account or provide Registration, Contact, or Account Information on behalf of an individual other than Yourself unless You are legally authorized to bind such person to these Terms. By registering another person, You hereby represent that You are legally authorized to do so.

By agreeing to these Terms, You acknowledge that Yeti My Friend may choose, but is not obligated, to make any inquiries, either directly or through third parties, that Yeti My Friend deems necessary to validate Your Registration, Contact, and Account Information, including, without limitation, contacting Your School if You are an Educator or engaging third parties to provide verification services. Yeti My Friend reserves all rights to take legal action against You if You misrepresent or are otherwise untruthful about Your identity.

By registering for an account and using the Services, You represent and warrant as follows:

  1. If You are a Learner under the age of 13, Your Guardian has provided consent using the method described in the Privacy Policy and Your Guardian has reviewed and agreed to these Terms of Use on Your behalf;
  2. If You are a Learner under the age of 18, Your Guardian has reviewed and agreed to these Terms of Use on Your behalf;
  3. If You are the Guardian of a Learner who will use the Services, You understand and agree that these Terms are a legally binding agreement between You, on behalf of Your Learner, and Yeti My Friend, and that the Terms are the equivalent of a signed, written contract;
  4. Your Registration Data is true, accurate, current, and complete;
  5. You will update Your Registration Data as needed to maintain its accuracy;
  6. You are authorized to create a User Account and/or to provide Registration, Contact, and Account Information to Us;
  7. You acknowledge and agree to the terms of the Privacy Policy; and
  8. You are not located in a country that is subject to a United States government embargo or that is designated by the United States government or the government of the United Kingdom as a “terrorist supporting” country, and You are not listed on any list of prohibited or restricted parties maintained by the government of the United States and/or the United Kingdom.
